On Monday, November 14th, Texas Republican Governor Greg Abbott announced that he is invoking a special Invasion Clause at both the state and federal Constitutions levels in an attempt to stop Joe Biden’s failed border policies from harming the country.
In a letter sent to Texas County Judges, the Governor assured that the state will continue to take “unprecedented action” to address Joe Biden’s historic migration crisis and urged the judges to encourage newly elected members of Congress to fulfil their responsibility in securing the border.
“Texas has forcefully responded to Biden’s open border policies by doing more than any state in the history of America to do the federal government’s job to secure the border,” reads the letter. “In January 2023 when the next Congress is sworn in, we must remind our representatives in Washington that securing the border is the federal government’s responsibility under Article I, § 8 and Article IV, § 4 of the U.S. Constitution. Join me in sending this urgent message to our congressional delegation, which has the power to act under Article I, § 8 of the U.S. Constitution. Texas has done more than its fair share for far too long. The time has come for the federal government to do its job.”
On Tuesday, November 15th, the Governor shared some details of his plans in a statement on Twitter.
“I invoked the Invasion Clauses of the US & Texas Constitutions to fully authorize Texas to take unprecedented measures to defend our state against an invasion,” the statement read.. “I’m using that constitutional authority, & other authorization & Executive Orders to keep our state & country safe.”
By treating the historical inflow of illegal immigrants into the country from the Southern Border as an “invasion” the state of Texas can tackle the issue with a sort of emergency powers.
In the statement, the lone star state’s Governor explained that he will be deploying a joint force of the National Guard and Texas Department of Public Safety to “repeal,” and arrest illegal immigrants trying to sneak into the country by exploiting Biden’s weak policies.

Gov. Abbott also stated his intentions of building a border wall in multiple Texas counties and deploying armed boats to tackle illegal migrants attempting to sneak in through waterways. Furthermore, his plan would designate the infamous Mexican drug cartels as foreign terrorist organizations.
The Customs and Border Patrol (CBP) reported over two million illegal immigrant encounters in the Fiscal Year 2022 alone.
Gov. Abbott noted in his announcement that Texas will be getting into a compact with other states and foreign powers to “enhance border security.”
And lastly, the effort would provide resources to many Texas border counties to increase local efforts to respond to the border invasion.
