Latest memos from Biden’s Department of Justice reveal that the DOJ had planned on sending federal poll monitors to 64 jurisdictions in 26 states ahead of Tuesday’s midterm elections. This memo violates several state laws that do not permit monitors to stay inside polling rooms or near polling places.
The Florida Department of State released a statement criticizing the DOJ’s plan to send federal poll monitors to Florida’s Broward county and Miami-Date county.

“Department of Justice monitors are not permitted under Florida law,” the statement reads, citing Section 102.031(3) which mentions that Florida Statutes “lists the people who ‘may enter any polling room or polling place.’ Department of Justice personnel are not included on the list. Even if they could qualify as ‘law enforcement’ under section 102.031(3)(a)6. of the Florida Statues, absent some evidence concerning the need for federal intrusion or some federal statute that preempts Florida law, the presence of federal law enforcement inside polling places would be counterproductive and could potentially undermine confidence in the election.”

The Florida State Department notes in the letter that the DOJ has failed to provide further details as to why federal government monitors are to be placed in these specific Democrat-run counties. “None of the counties currently subject to any election-related federal consent decrees. None of the counties have been accused of violating the rights of language or racial minorities or of the elderly or disabled,” the letter adds.
“Your letters simply provide a non-exhaustive list of federal elections statutes as the basis for this action without pointing to any specific statutory authorization. When asked for specific authorization during our phone call this evening, you did not provide any,” the letter further reads.
